Rights and Reproduction Information

Photographic materials of objects owned by the Eiteljorg Museum are available to scholars, educators, publishing companies, and commercial entities, with prior written approval of the museum. If you would like to request images, please fill out a request form and return it to the museum’s Registrar via mail or fax.

Please plan ahead when requesting images. Normal processing of requests takes four to six weeks. Rush requests will be considered individually and may require additional fees.


Fee Schedule

Fees are subject to change without notice. All rental materials remain the property of the museum and must be returned within three months of receipt. Non-profit fees apply to personal or academic use or use by an organization such as an educational institution (school, university, museum, library), church, charity, or non-profit, tax-exempt [501(c)(3)] organization. Commercial fees apply to businesses such as commercial publishing houses utilizing our photographic materials for profit. Permission is granted for non-exclusive, one time usage, in one language. Additional languages and subsequent editions will be considered upon application.

Lo-res images sent on disc or electronically are available for research or review. Fees will be determined on an individual basis.

  • Credit line for all reproductions must read: “Courtesy of the Eiteljorg Museum of American Indians and Western Art, Indianapolis.” Copyright notice will be provided as appropriate.
  • All publication fees are for print runs under 5,000; all CD-ROM fees are for print runs under 1,000. For larger print runs, please contact the Registrar at the Eiteljorg Museum. Web site permissions are granted in perpetuity, provided the content and purpose of the web site is not substantially changed.
  • Any and all other special requests will be subject to prior approval by the Museum.

Postage and Handling charges vary and can be calculated at time of order.


Copyright Information

There are many works in the Eiteljorg Museum for which the Museum does not own the copyright. While the Museum will furnish as much information pertaining to copyright as is possible, it is the ultimate responsibility of the applicant to research outside copyrights. This can be an extremely complex and time-consuming process, so all applicants are advised to allow adequate time to do this research and apply for the appropriate permissions.

In the case of living artists, the Eiteljorg Museum will require the artist’s permission in writing before releasing any photographic materials. It is the responsibility of the applicant to obtain this permission.


Terms and Conditions
  1. Photographic materials must not be used for any purpose other than that listed on the permission form, nor may they be assigned to any other person or firm. Any and all reprints, further editions, re-employment of the printing plates or additional use of any kind must be preceded by a new application and is not covered by the original fee or permission form.
  2. Permission can be granted only in writing and on the museum’s permission form.
  3. Payment in advance is required. Fees are non-refundable under any circumstances.
  4. All rental material must be returned to the museum (c/o Registrar) at the end of the agreed rental period. Renewal may be possible in some circumstances; however, the Registrar must be notified one week before the end of the original rental period of any renewal needs. Failure to do so will result in monthly late fees.
  5. The museum prohibits the duplication of any photographic materials sold or rented.
  6. Reproduction is permitted only from materials supplied by the museum. Production from printed or other non-photographic materials, or from photographic materials not supplied by the museum, is strictly prohibited.
  7. Reproductions cannot be cropped, superimposed, bled off the page, airbrushed, reproduced on colored stock, or otherwise altered in appearance. If a detail is to be used, it must be approved in advance and so stated herein.
  8. Responsibility for researching outside copyrights falls to applicant.
  9. The museum makes no warranties or representations and assumes no responsibility whatsoever for any claims against applicant or the museum by the artists, their agents, estates, or by any parties in connection with the reproduction of works of art in the collections of the museum. The applicant agrees to indemnify the museum and hold it harmless against any and all such claims, including copyright infringement claims, royalty or fee demands and/or actions, including the costs thereof arising as a result of the applicant’s reproduction of the works of art in the museum. Outside parties hold copyrights to many of the works in the museum. Any and all royalty payments or other requirements specified by the copyright owner of such a work must be paid or honored by the publisher or agent requesting reproduction permission. In the case of living artists, the applicant must deliver the artist’s permission in writing before the museum will release any photographic material.
  10. The museum reserves the right to decline to provide photo reproductions to applicants who have not complied with its policies or whose products are unacceptable to the museum for any reason.
  11. Two (2) copies of the publication described above in which the reproduction appears shall be donated to the Museum.
  12. *The Eiteljorg Museum does not have publication quality photography facilities located on-site. If an image is not in the museum’s library, the requestor will be notified. Requests for publication quality images are contracted to vendors outside the museum and new photography fees will apply.

The following terms and conditions apply to electronic publication and web use:

  1. The client is licensed to store the images in his digital database for the duration of this agreement only. The copyright in any digitized version or copy of these images made in the course of the permitted use of the photo shall be retained by the Museum.
  2. Maximum resolution on product: 600 x 800 pixels, 72 dpi
    Maximum file size on product: 100 kb
  3. The Eiteljorg Museum retains the right to view and approve at the beta stage all scans and the accuracy of identifying text.
  4. All digital images will be protected by at least one of the following means:
    1. Download, Print, Save As, Copy, Paste functions disabled.
    2. Watermarking: credit line, The Eiteljorg Museum of American Indians and Western Art, appearing on the image near the bottom edge, or directly alongside or under each image.
    3. File encryption.
    4. Commercial intellectual property software.
    Images will be limited to no larger than half-screen size and will be embedded for viewing purposes only. It is recommended that the site and product(s) also include a general copyright warning regarding all intellectual property included therein.
  5. The producer/publisher accepts full liability for infringement of the Eiteljorg Museum copyright material due to non-conformance with terms 9, 10, and, 16 above.
  6. If the proposed product is not produced, the licensed rights automatically revert to the Eiteljorg Museum and the Museum must be notified.
